RIFA MOBILE APPLICATION TERMS AND CONDITIONS OF USE
GENERAL CONDITIONS
These General Conditions define the rules applying to the AFIR.info mobile application belonging to the Rural Investments Financing Agency (RIFA), hereonout called "AFIR.info" by visitors or users (potential beneficiaries/ applicants of the National Rural Development Program, as well as consulting/ design companies, traders, bidders and applicants), who already have an account and those who don’t have one yet, as the case may be, on the RIFA website or in this application.
By accessing and browsing using this mobile application, you are effectively accepting the terms of use described below.
The information presented within and with the help of this application does not represent the official position of the European Commission. The full responsibility for their correctness and consistency belongs to the Agency.
The permitted purpose for using the RIFA application is to obtain information about available funding through the National Rural Development Program, as well as access to public interest services offered through this application. It is not allowed to use the information or documents for purposes other than the free, non-discriminatory and transparent information of the general or the target public, as the case may be.
USE OF THE PUBLIC INFORMATION SYSTEM OF THE RURAL INVESTMENTS FINANCING AGENCY (RIFA)
RIFA, as the operator of the public information system, makes every effort to ensure the utmost accuracy of the documents/information made available to the users of the information system.
RIFA disclaims any responsibility regarding the unavailability of the IT system due to reasons beyond its control or due to technical reasons and assumes the obligation to make all the necessary efforts to remedy such situations promptly and impartially.
The information available on the web application does not necessarily replicate the text of an official document.
While accessing and/ or using the mobile application, the following actions are prohibited:
- transmitting by any means, or displaying within or with the application any information that is threatening, false, misleading, abusive, harassing, licentious, slanderous, vulgar, obscene, scandalous, inciting, pornographic or profane, as well as any other material that may constitute or encourage behavior that could give rise to a crime, could lead to civil liability, or would otherwise break the law;
- transmitting by any means any file that contains viruses or any other code sequences or programs created to interrupt, damage or limit the functionality of any hardware or software component of the application or that may facilitate obtaining additional rights to those legally granted by to the IT system operator;
- transmission of false/ untrue information, on the occasion of registration in the computer system, in order to hide a situation which, if had been known, would have led to the refusal of registration or the renewal of registration;
- unauthorized modification of identification elements in order to hide the origin of any electronic content transmitted through it to the computer system;
- transmission by any means of any content for which the user of the computer system does not have, according to the legislation in force, the right to use, as well as the right to make it public;
- the transmission by any means of any content that violates, according to the legislation in force, any intellectual or industrial property right;
- transmission by any means of any unsolicited content;
- use of the application for advertising purposes;
- any other actions likely to affect the proper functioning of the IT system;
- accessing the data or services offered by the web application other than through the interfaces provided by it, any other approach, in particular the use of programs or techniques that facilitate access to data or services, in a way other than that provided by the application, will be considered illegal interference.
- activities aimed at malfunctioning, blocking, rewriting or modifying the content of the web application:
- scanning, probing or testing the vulnerability of any system or component of the application;
- accessing any servers or services of RIFA, which are not public, as well as attempting to act for this purpose;
- absolutely any intervention in the operation of the hosting servers or RIFA networks by any means, including attacking them by "flooding" or "DOS”;
Violation of any of the above-mentioned rules entails civil or criminal liability. RIFA will cooperate with the authorities to prevent or forewarn such violations and to investigate facts involving such violations.
According to art. 360 Penal Code - Illegal access to a computer system:
(1) Unauthorized access to a computer system is punishable by imprisonment from 3 months to 3 years or a fine.
(2) The fact provided for in item (1), committed in order to obtain computer data, is punishable by imprisonment from 6 months to 5 years.
(3) If the act provided for in item (1) was committed with respect to a computer system to which, by means of specialized procedures, devices or programs, access is restricted or prohibited for certain categories of users, the penalty is imprisonment from 2 to 7 years.
According to art. 363 Penal Code - Disrupting the operation of computer systems, "The act of seriously disrupting, without right, the operation of a computer system, by introducing, transmitting, modifying, deleting or damaging computer data or by restricting access to computer data, is punishable by imprisonment from 2 to 7 years."
At the same time, any violation of the safety and integrity of the IT systems and data are punished according to the Criminal Code in force - Law no. 286/ 2009.
RIFA reserves the right to modify or discontinue, temporarily or permanently, in part or in whole, the services made available to visitors and users through this application, without prior notice. RIFA is not liable to users, any third-party, legal entity or institution for the modification, suspension or interruption of the services available through the application for reasons beyond its control.
PERSONAL INFORMATION
Any information requested from you, through this application, is being done for the purpose of identifying you or being able to contact you.
The processing of personal data will be made in accordance with the DCP Processing Terms.
PRIVACY
RIFA will take all appropriate technical and organizational measures to protect your personal data against accidental or unlawful destruction, loss, alteration, disclosure or unauthorized access.
The User is responsible for maintaining the confidentiality of the passwords associated with the account they use to access the Web Application.
This application uses "cookies" files, in accordance with the Cookies Policy.
Copyright, Trademark and Intellectual Property
The content of the application is the property of RIFA and its partners who, as appropriate, will be cited as the source of the content and may not be retrieved, broadcast, sold or resold, in part or in whole, except with the written consent of the institution.
If you wish to retrieve and make public, by any means, any type of content on the web application, you can contact us at the telephone numbers and email addresses provided.
The objective of this application is to facilitate access to information of public interest by visitors and users. This application is being organized into two levels of use and provides personalized information based on your profile type.
RIFA reserves the right to make changes in the content and/or structure of the application at any time, as well as to add new rules and restrictions regarding the content of the application, at any time and without any prior information to its users.
Users are not allowed to modify this application in any form and way, except in the sections where they are allowed to do so.
RIFA may, at any time and without prior notice, revise these Terms of Use by updating them. By accessing this web application, you undertake to comply by any and all such revisions and therefore you should visit this web application periodically to become aware of any updates to these terms and conditions.
